Terms of service
These terms and conditions of service govern the use of the services provided by Monday Project Co. (hereinafter referred to as "the Service Provider"). By booking an appointment, partnering with us as a client or brand or using our website and services, you agree to these terms and conditions.
1. Services and Payments
Description of Services
The Service Provider offers professional fashion styling and related services. We reserve the right to modify or discontinue any service without prior notice.
Payment Terms
We require 100% payment upfront for all services unless otherwise agreed upon. If you prefer a payment plan or deposit, please contact us to discuss. We accept Mastercard, Visa, and bank transfers. Your appointment will be confirmed upon receipt of payment. If payment is not made, the appointment may be released.
If you have not paid 100% upfront, late payments will incur an additional 10% fee in the first month. This continues for subsequent months, increasing by an additional 10% per month to encourage timely payments and cover the costs associated with delayed transactions.
2. Cancellation and Refund Policy
Appointment Cancellations
Notice Period: To cancel or reschedule an appointment, please provide a minimum of 48 hours’ notice.
Late Cancellations: Cancellations made within 24 hours of your booking incur a cancellation fee of 50% of the service cost.
No-Shows
Definition: Failure to attend your appointment without prior notice will be considered a no-show.
Fee: No-shows will be charged 100% of the service cost.
Rescheduling
Rescheduling requests must be made at least 48 hours in advance.
Emergencies
We understand that emergencies can happen. If you need to cancel or reschedule due to an emergency or illness, please contact us as soon as possible.
Refund Policy
Full refunds are issued for cancellations made a minimum of 1 week before the appointment.
No refunds will be provided for late cancellations, no-shows, changes of mind, or rescheduling made within 24 hours.
If you wish to transfer your appointment to a friend or family member, please contact us to arrange this.
Processing of Refunds
Refunds will be processed within two weeks of the cancellation notice.
3. Use of Services
You agree to use the services provided by the Service Provider only for lawful purposes and in accordance with these terms and conditions. We reserve the right to terminate your access to the services at any time for any reason without prior notice.
4. Intellectual Property
All content and materials provided by the Service Provider, including but not limited to logos, trademarks, and website content, are the property of the Service Provider and are protected by applicable copyright and trademark laws.
4.1 Ownership of Content
All content created by Monday Project Co, including but not limited to videos, reels, photographs, copywriting and other creative material (“Content”), remains the sole intellectual property of Monday Project Co, unless otherwise agreed in writing.
4.2 Usage Rights
Upon full payment, the brand is granted a limited, non-exclusive, non-transferable licence to use the Content for the specific purposes and platforms outlined in the original agreement or brief.
This licence includes:
- Organic use (e.g., reposting to the brand’s social media, website integration, social media collaboration) for a maximum period of 30 days from the original Monday Project Co posting date, unless otherwise agreed in writing.
- Use of the Content only on the following platforms; Instagram, Facebook, TikTok, Pinterest, YouTube, Website Integration.
This licence does not include:
- Use of Content in paid media or whitelisting, refer 4.3 and 4.4.
- Reposting, resharing, or repurposing Content beyond the 30-day usage period without a renewed licence.
- Use across additional platforms, in print, PR, or in third-party partnerships unless specifically agreed in writing.
4.3 Paid Advertising & Extended Use
Use of Content in paid advertising (e.g., Meta Ads, Instagram/Facebook Ads, TikTok Ads, Pinterest Promotions, YouTube Ads, or any other form of paid digital campaign) is not included in the standard content licence.
Such usage requires a separate written agreement and will be subject to additional licensing fees. Any continued or renewed use of Content after the original campaign or usage period must also be re-licensed.
4.4 Whitelisting
Whitelisting is defined as a brand running paid ads through Monday Project Co’s social media identity (e.g. using Monday Project Co’s handle, collaboration or account access in Meta Ads, TikTok Spark Ads, or similar) — must be pre-approved in writing.
Whitelisting arrangements are subject to the following;
- A separate agreement and clearly defined campaign terms, including content, copy, budget, targeting and timeline.
- Additional fees depending on the scope and duration of the whitelisting period.
- Strict approval and oversight by Monday Project Co, with the right to revoke permission at any time if terms are breached.
4.5 Raw Files & Source Material
Monday Project Co does not provide raw content files (e.g. unedited videos or ‘drafts’, photo galleries, or story footage) unless agreed upon in writing prior to project commencement.
Only final, edited deliverables, as outlined in the original brief, will be supplied to the brand.
4.6 Unauthorised Use
Any use of Monday Project Co’s Content beyond the agreed scope, including but not limited to, unauthorised paid media use, whitelisting, reposting outside the licensed period, or platform expansion, is a breach of this agreement. This breach may result in retrospective licensing fees.
Brands are prohibited from:
- Using expired or out-of-scope Content after the 30-day organic use period, unless a new licence is purchased.
- Taking or distributing screenshots, screen recordings, or any reproductions of Content across Instagram, Facebook, TikTok, Pinterest, YouTube, or other platforms without written permission.
- Re-uploading, resharing, editing, or repurposing Content for new campaigns, new product launches, or new platforms without renewed approval.
This includes capturing and using any part of Monday Project Co’s content, including Stories, Reels, Feed Posts, TikToks, Pins, YouTube Shorts, or long-form video, in ways not originally agreed.
4.7 Moral Rights
Monday Project Co retains moral rights in all Content, including the right to attribution and the right to object to any use that may negatively impact the brand’s personal or professional reputation. Content must not be edited, altered, or used in a misleading or damaging context.
5. Limitation of Liability
The Service Provider shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of its services.
6. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
7. Privacy Policy
The Service Provider respects your privacy and is committed to protecting your personal data. By using our services, you consent to the processing of your personal data in accordance with our privacy policy.
8. Confidentiality
We agree to maintain the confidentiality of any information provided by you in connection with our services. We will not disclose such information to any third party without your prior written consent, except as required by law.
9. Warranties and Disclaimer
The Service Provider makes no warranties or representations about the suitability, reliability, availability, timeliness, or accuracy of the services provided. Services are offered “as is” without warranty or condition of any kind.
10. Indemnification
You agree to indemnify and hold the Service Provider harmless from any claims, damages, expenses, or losses arising out of your use of the services.
11. Entire Agreement
These terms and conditions, together with any additional agreements entered into between you and the Service Provider, constitute the entire agreement and supersede all prior agreements and understandings.
